Accommodation Only Booking Terms

These Terms of Service outline the relationship between you and View Retreats ABN. 56 219 876 466 in relation to the provision of accommodation booking services and other Services as outlined below. By using the Services you agree that you are at least 18 years old and have read, understood and agree to be bound by these terms and our Supplier terms & conditions.
1. Travel Services
View Retreats provides an online platform and support services to facilitate bookings of accommodation and associated services with travel providers (Operators) and other third party providers (Suppliers). By making a booking on the View Retreats Site you enter into a direct (legally binding) contractual relationship with the Supplier of the service and/or their Operators. All Bookings are subject to the Supplier's terms and conditions and any Operator terms provided at the time of Booking, which should be read in conjunction with these Terms. Our role is limited to facilitating Bookings on behalf of the Supplier and/or Operator.
The travel services (‘Services’) provided by View Retreats comprise;
a) Accommodation booking services offered via third-party Suppliers
b) Other travel goods or services offered via third-party Suppliers
c) Customer service provided by Us and third-party Suppliers
2. Website Information
a) Travel product information that is accessible via the Site, including rate and availability information, is provided by third-party Suppliers and does not form part of the Services. View Retreats cannot accept responsibility for this information as it relies on its Suppliers for this information, and disclaims any liability for the accuracy or completeness of this information.
b) Travel product information is subject to amendment at any time without notice.
c) You should make your own evaluation of the accuracy or completeness of any information provided via the Site.
d) Terms vary for every travel product. You should read all of the terms and conditions specific to the travel product you are booking before you finalise your Booking.
e) View Retreats makes no representation that product rates are identical to or better than rates available on other travel websites.
3. Site Usage
The Site, including Website Information and HTML code, is provided for the purpose of personal use only. Any other use, commercial or otherwise, without the express written permission is strictly prohibited including any monitoring, reproduction, hot-linking, scraping, data mining, automated querying or similar data extraction techniques.
4. Travel insurance
Travel insurance is highly recommended for all local and international travel bookings to provide cover for any unforeseen circumstances. Travel insurance is available to purchase on the Site via third-party Suppliers. Before purchasing insurance you should read the product disclosure statement thoroughly and consider whether the insurance is suitable for your needs.
If you purchase insurance:
a) you enter into a contract in respect of that insurance directly with the third-party Supplier
b) View Retreats does not act as an insurer or provide that insurance to you
c) View Retreats has no responsibility for and excludes all liability in relation to that insurance, including in relation to any claims made by you under it.
5. Customer Obligations
You must be at least 18 years of age to make a Booking via the View Retreats Site. You understand that the advice provided by our customer service team is general in nature and that any clarifications, special requests or requirements that are important for your Booking should be confirmed directly with the Operator. You are solely responsible for deciding whether a destination, accommodation or associated service is suitable for your needs and reviewing relevant government advice for the destination you are planning to visit. You are also responsible for all matters relating to complying with the laws and regulations of all immigration authorities and governments of the countries you travel to and from. By offering booking services for travel goods and services in particular international destinations, we do not represent or warrant that travel to such areas is advisable or without risk, and are not liable for damages or losses that may result from travel to such destinations.
6. Feedback & Complaints
Feedback and complaints relating to our Site or services should be directed to [email protected]. Feedback and complaints relating to accommodation and associated services should be addressed immediately with the Operator. Where necessary, a follow up written complaint should be sent directly to the Operator within 7 days. Any grievance or complaint leading to a dispute is strictly between you and the Operator. View Retreats will not act on behalf of you or the Operator in a dispute.

8. Copyright
Images & text throughout the Site are copyright protected. Images may not be reproduced, copied, transmitted, or manipulated without the written permission of the respective copyright holders.
9. External Links & Services
The Site may contain links to third party websites or resources. We do not endorse and nor are we responsible or liable for the reliability, availability or accuracy of such websites. Some parts of the Site use additional third party services such as Facebook Login or Google Maps. Your use of these services is subject to the respective terms and conditions of each service provider.
10. Changes to these Terms
These Terms may be updated or changed at any time without prior notice. Changes will be posted on our Site. By continuing to use the Site you are indicating that you agree to be bound by the modified Terms.
11. Liability
Without exclusion or limitation of your statutory consumer rights, we will not be liable for any losses, damages, liability, claim or expense (howsoever caused, including negligence, and whether direct, indirect or consequential) arising from the use of or connected with our Site or any products or services purchased via our Site. We make no warranty or representation as to the fitness or suitability of any product or service displayed on our Site or any linked site. Where our liability cannot be excluded, to the extent permitted by law such liability is limited to the value of the booking made. You acknowledge that you will be liable for any illegal, improper, inappropriate or defamatory material which you may post to the Site and you will indemnify View Retreats, its Suppliers and Operators from any claim, demand or loss arising out of such posting, your violation of the law or the rights of a third party, or your use of this Site.
12. Provisions
If any provision of these Terms is or becomes invalid or non- binding, the Parties shall remain bound by all other provisions.
13. Governing Law
These Terms are governed, construed, and enforced in accordance with the laws of Victoria, Australia.

“View Retreats”, “we”, “us” or “our” means View Retreats Pty Ltd as trustee for The View Retreats Trust ABN. 56 219 876 466. “Site” refers to the website and subdomains of https://www.viewretreats.com. “Operator” means the owner or manager of an accommodation or experience. “Supplier” means the provider of travel products, services or experiences, and where the context permits, their authorised agents. “Terms” means these Terms & Conditions. “Booking” is when you have received a confirmation of your reservation from the Operator.

Holiday & Tailor-made Booking Terms

These Terms apply when you book Holidays and Tailor-made Journeys with us, View Retreats Pty Ltd ABN 56 219 876 466. (We/Us).
1. Travel Services
View Retreats provides an online platform (the ‘Site’) and support services to facilitate bookings of Holidays and Tailor-made Journeys (‘Travel Services’) which may consist of:
a) Package holiday and tour services offered via its Suppliers.
b) Accommodation, transport, services, amenities and/or facilities offered via its Suppliers.
c) Customer services provided by Us and our Suppliers.
2. Our Suppliers
View Retreats is not and does not own or operate any entity which provides Travel Services. View Retreats acts as a merchant and agent for its Suppliers.
View Retreats purchases / books transportation (by aircraft, coach, train, vessel or otherwise), accommodation (in a hotel or other lodging), restaurant, ground handling and other services, amenities and/or facilities from various independent suppliers. Our Suppliers are independent contractors.
When your booking is confirmed (by payment of the deposit), a contract comes into existence between Us and you the Customer for the provision of the Travel Services. At the same time, you the Customer also form a contract with the Supplier for the provision of the Travel Services.
3. Website Information
a) Holiday itineraries and prices shown on the website are illustrative only. We do not guarantee availability of all accommodation, products and services listed. Prices are indicative only and are subject to confirmation or change when a booking is made.
b) “From prices” listed throughout the website for holidays are indicative only. These prices are listed per person, based on twin/double share basis and are usually for travel in the low season. Single supplements may apply for customers travelling on their own.
c) Prices vary across date ranges, are subject to availability and to change due to factors including currency exchange rate fluctuations, fuel levies, new taxes or tax increases, which apply to the booking.
d) We will provide the best available price for the Customer’s preferred travel arrangements and dates upon receiving a booking enquiry. Final costs are subject to the Quotation provided and payment. Quotations are valid for 7 days.
e) Surcharges may be incurred for circumstances beyond our control as a result of currency exchange rates, increases in prices, such as fuel levies, the imposition of new or amended government taxes or charges, scheduled airfares, hotel, cruise and ground transportation charges, park entrance fees, and any other increases in connection with the Travel Services. We reserve the right to impose surcharges at any time before departure. In such instances we will be responsible for any amount up to 2% of the price and you will be responsible for any amount above 2% of the price. If any surcharge results in an increase of more than 10% of the price you may cancel the booking within 14 days of notification of the surcharge and obtain a full refund, provided that no cancellation will be accepted after departure.
f) Inclusions vary for every holiday. Inclusions and exclusions for each holiday can be found in the holiday trip notes and/or the Quotation. All holidays exclude international and domestic airfares unless specified as included in the itinerary. Costs associated with obtaining passports or visas; border fees; travel insurance coverage; items of a purely personal nature such as drinks, laundry, dry cleaning, internet, phone charges; transfers, sightseeing or meals not specified in itinerary; excess baggage charges; airport departure taxes; gratuities are not included unless expressly included in the itinerary.
g) Travel Services information is provided in good faith and is subject to amendment at any time without notice.
h) Every endeavour has been made to ensure information and pricing provided on the website, the Quotation and in the trip notes is accurate and up to date. You should make your own evaluation of the accuracy or completeness of any information provided.
i) General booking and payment terms may vary for some products or services and at certain times of the year. These will be specified in the Quotation and trip notes.
j) View Retreats makes no representation that product rates are identical to or better than rates available on other travel websites.
4. Bookings, Deposits and Payments
a) Customers initiate the booking process by lodging an online enquiry, after viewing the example itineraries and pricing on the Site.
b) Our representative will initiate a consultation process via email and/or phone.
c) If you are happy to proceed, we will issue a Quotation which can be accepted by payment of a deposit, or full payment, as may be specified on the Quotation.
d) The Quotation will specify a non-refundable deposit of 20% of the total cost, if a deposit is specified to secure the Booking. If so, full payment is required 90 days prior to departure. The Quotation will specify full payment if the Booking is made within 90 days of departure.
e) You make the Booking by making payment as specified in the Quotation along with the full names of all guests as specified in their passport (and copies of the passport photo pages). When received by Us, we will issue a confirmation of the Booking. We reserve the right to withdraw the Quotation at any time before issuing confirmation of the Booking.
f) The deposit amount may vary if certain products or services are added to the holiday itinerary, or if the booking is made over special periods. This will be advised in the Quotation and trip notes.
5. Travel Insurance
a) Comprehensive Travel insurance is mandatory for all customers travelling on a View Retreats Holiday or Tailor-made Journey.
b) Prior to the final balance due date, you will be required to provide evidence of international travel insurance coverage that includes cover for circumstances such as cancellation, medical, hospital dental and repatriation expenses for illness, personal injury or death, cover for loss of baggage, money and valuables, personal liability, delay, curtailment, missed departure and legal expenses for public liability.
c) Travel insurance is available to purchase on the Site via third-party suppliers. Before purchasing travel insurance, you should read the product disclosure statement thoroughly and consider whether the insurance is suitable for your needs. You should also make all disclosures requested, particularly pre-existing medical conditions. If you purchase insurance:
i. you enter into a contract in respect of that insurance directly with the insurer
ii. View Retreats does not act as an insurer or as an insurance broker to provide that insurance to you
iii. View Retreats has no responsibility for claims you may make and excludes all liability in relation to the cover that the insurance may or may not provide.
6. Changes by the Customer
a) Changes to the Travel Services may be requested by the Customer up to 91 days prior to the departure date. If the booking has already been confirmed with a deposit, then additional costs and fees may apply.
b) Changes made by the Customer within 90 days of the departure date are treated as cancellations and re-booking, and will be subject to the cancellation fees outlined below.
7. Cancellations by the Customer
a) The Customer must notify View Retreats in writing of their intention to cancel any of the Travel Services. Charges apply to all cancellations according to when the cancellation is received in relation to the departure date

b) No refunds are made in respect of Travel Services booked but not utilised, for example, flights, accommodation, meals and sightseeing excursions.
8. Changes or cancellations by View Retreats
a) Occasionally we may need to make changes or correct errors in our booking information both before and after bookings have been confirmed. We may also have to cancel all or part of a confirmed booking due to factors outside our control.
b) Whilst we always endeavour to avoid changes and cancellations, we reserve the right to do so. We will notify you (or your travel agent) of a change or cancellation at the earliest opportunity. Most changes are minor (in which case the change will not entitle you to a refund or to change your holiday and no compensation will be due) but occasionally we may have to make a significant change.
c) A significant change is a change made before departure which we can reasonably expect to have a major effect on your holiday. Significant changes could include a change in your destination locality or a change of accommodation to that of a lower standard. If we have to make a significant change we will inform you (or your travel agent) as soon as reasonably possible.
d) If there is time to do so before departure we will offer you the choice of one of the following options:
i. accepting the changes (for significant changes) or
ii. purchasing an alternative holiday from us, of a similar standard to that originally booked or
iii. cancelling or accepting the cancellation and receiving a full refund of all monies due. If the alternative holiday is cheaper than the original one, we will refund the price difference, and if it is more expensive you will be charged for the difference.
e) View Retreats may need to change or cancel part or all of your booking due to a Force Majeure Event.
View Retreats and, where applicable, any relevant Supplier, shall be excused from performance of their respective obligations under these Terms to the extent that we are prevented from acting due to circumstances amounting to a Force Majeure Event, for as long as such circumstances last and affect such performance.
To the maximum extent permitted at law, we are not liable to the Customer or any third party in any way whatsoever to the extent provision of the Travel Services, or availability of the whole or any part of the Travel Services, is impacted by a Force Majeure Event, and we may:
(a) suspend or terminate the Travel Services by written notice to the Customer;
(b) cancel the whole or any part of the Travel Services;
(c) offer the Customer alternative Travel Services of comparable standard as we may consider to be appropriate in the circumstances; or
(d) elect to offer the Customer, at our discretion:
(i) travel credit with us in the sum of the Refundable Amounts; or
(ii) a refund in the sum of the Refundable Amounts.
9. Feedback & Complaints
a) Feedback and complaints relating to our Site or booking services should be directed to [email protected]. We will respond to your feedback or complaint within 7 days.
b) Feedback and complaints relating to provision of Travel Services at your destination (e.g. accommodation, transfers, cruises ) should be addressed immediately with the service provider. Where necessary, a follow up written complaint should be sent directly to the service provider and maintained by you as evidence. If your complaint is not resolved by the service provider, you should contact our Supplier using the details provided in your trip notes.
c) If you are unable to resolve any issues while on holidays and remain dissatisfied, you must write to us at [email protected] within 28 days of your return with full details. Your right to any possible compensation will be dependent on you having followed the procedure outlined in Clause 9b.
10. Customer Obligations
a) You must be at least 18 years of age to make a Booking via View Retreats.
b) You understand that the advice provided by our customer service team is general in nature. If you have any special requests or requirements you must advise us in writing. We will pass on all such requests and requirements to our third party suppliers and will endeavour to ensure that they are met. However we cannot guarantee that such requests and requirements will be met and will have no liability to the Customer if they are not.
c) You are solely responsible for deciding whether a holiday, destination, accommodation or associated service is suitable for your needs and for reviewing relevant government advice for the destination you are planning to visit. We highly recommend that you sign up to receive alerts from your government travel advisory service if you are travelling internationally.
d) You are also responsible for all matters relating to complying with the laws and regulations of all immigration authorities and governments of the countries you travel to and from.
e) By offering Travel Services in particular international destinations, View Retreats does not represent or warrant that travel to such places is advisable or without risk, and we are not liable for damages or losses that may result from travel to such places.
f) You are responsible for booking all travel (unless specified otherwise), and for obtaining requisite passports, visas and vaccinations.

Gift Voucher Terms

Gift Voucher Terms

These Terms apply when you purchase or redeem a Gift Voucher with us, View Retreats Pty Ltd ABN 56 219 876 466. (We/Us).
1. Gift Vouchers
View Retreats offers gift vouchers that can be purchased and used to pay for View Retreats Holidays, Tailor-made Journeys, and some Accommodation. In terms of gift vouchers, our role is limited to facilitating payment for the Service(s) you select from our Supplier(s) and/or Operator(s). Normal Supplier and/or Operator terms and conditions apply to all gift voucher bookings.
2. Purchasing a Gift Voucher
a) A gift voucher can be purchased via the View Retreats website for any amount in AUD only.
b) A surcharge of up to 2% applies for payments made via Credit Card.
c) When you purchase a gift voucher for another individual, you warrant that you are authorised to provide their personal information for the purposes set out in our privacy policy. This includes, for example, using their email address to verify their identity or undertake redemption of their gift voucher.
3. Redeeming a Gift Voucher
a) Gift vouchers can only be redeemed through a View Retreats customer service representative within the validity period by phoning (+61) 1300 368 337 or emailing [email protected]. Vouchers cannot be redeemed through the website booking engine nor directly with accommodation Operators or travel Suppliers.
b) Gift vouchers can be used as part or full payment for any View Retreats Holiday, Tailor-made Journey, or any View Retreats accommodation that offers a ‘pay now’ option at checkout.
c) Vouchers cannot be purchased for a specific holiday or individual accommodation as prices vary according to dates and availability. Vouchers cannot be purchased for accommodation that only offers a ‘pay later’ option at checkout.
d) All bookings are subject to availability, these website Terms of Services, the Supplier Terms & Conditions, and the accommodation Operator’s terms.
e) Full payment of the entire booking amount is required upon booking accommodation when using a voucher. Normal payment due dates apply for Holiday and Tailor-made Journeys when using a voucher.
f) Gift vouchers are not transferable nor redeemable for cash.
4. Gift Voucher issue & reissues
An electronic PDF gift voucher is issued within 24 business hours of purchase. It can be sent via email to either the purchaser or receiver. It is the responsibility of the purchaser to provide correct details during the order process. Vouchers can be reissued upon confirmation of the original purchase details. For security reasons, we will only reissue a voucher to the purchaser.
5. Gift Voucher expiry, extensions & cancellations
The expiry date for gift vouchers is 36 months from the date of purchase. If you are unable to redeem your voucher within the 3 year validity, we will extend the expiry date by 6 months upon request. To extend the validity of a voucher you must contact us for an extension prior to the expiry date. We are unable to redeem or reissue expired gift vouchers under any circumstances. Any unused balance upon expiry cannot be credited or refunded. If you cancel a booking made with a gift voucher, and the booking is refundable, any amount refunded will be provided in the form of a gift voucher with the same expiry date as the original gift voucher.
6. Gift Voucher refunds & remaining balances
Gift voucher purchases are non-refundable at all times. Remaining balances will remain on file for the validity of the voucher and can be put towards future purchases. Vouchers & remaining balances are non-transferrable or redeemable for cash.

We are committed to protecting the privacy of our users. To ensure the protection of personal data, we adhere to the Australian Privacy Act 1988 (Commonwealth) and the National Privacy Principles.
WHAT INFORMATION DO WE COLLECT?
Personal Information
The type of personal information we collect from you depends on the interaction that you have with our Site. For example, to register for our updates we may ask for your name and email address. To make a Booking we may ask for additional information including, but not limited to, your telephone number, address, ages of children, special dietary requirements & payment details.
Non-Personal Information
We also collect non-personal information such as data relating to the activities you perform on our Site. This is called ‘non-personal’ information because it does not reveal your identity. This includes, but is not limited to, device type, where you were referred from, pages viewed, duration on each page, path through the site and enquiry statistics.
HOW DO WE COLLECT YOUR INFORMATION?
Personal information is collected via information you provide to us on our website, or in emails or phone calls with our team. We may also receive personal information if you use a third party site, such as Facebook or Google, to login to our Site. By entitling View Retreats to gain access to any third party accounts you understand that we may access, store, and use any content you have made publicly available on and through these accounts according to the terms that apply to that third party site.
Non-personal information is collected through a variety of tracking technologies including cookies. A cookie is a small tracking file that is placed on your hard drive allowing us to identify your computer, but not you personally. It allows us to remember you and enhance your experience with the Site. You can set your browser to refuse cookies however you may not be able to enjoy all of the facilities or book on our site if you do so.
HOW DO WE USE YOUR INFORMATION?
We only disclose your personal information to Suppliers and Operators for the purposes of arranging the services you have Booked through us. Please note that in some cases the Supplier or Operator may be based in a country that may have different privacy laws to Australia.
We will use your email address and phone number to contact you about your booking, and from time to time with information about updates, offers and new services. You may update your subscription preferences at any time.
We may also disclose your personal information as required by law. This may include law enforcement officials investigating fraud or suspected unlawful activity, or Government officials in the case of an accident, disaster or emergency.
We use your non-personal information to tailor your experience on the Site and deliver the best information and services to you. We collect information relating to customer trends and patterns and use cookies and software tools to measure site usage and related information.
PROTECTING YOUR INFORMATION & KEEPING IT ACCURATE
The security of your information is important to us and we take all reasonable steps necessary to protect it. Personally identifiable information is stored on secure servers that are not publicly accessible and are located in secure facilities. This information is only accessible by View Retreats employees and contractors. Credit card details supplied by you are not stored on our network or databases.
We take all reasonable measures to ensure that the personal information we collect, use or disclose is accurate, complete and up-to-date. If you believe that your information is not accurate or you would like to request access to your information, please contact [email protected].
Website Security
We regularly review security and have policies in place to prevent information from loss, misuse, unauthorised access, modification and disclosure. While we strive to protect the personal information and privacy of users of the Site, we cannot guarantee the security of any information that you disclose online and you disclose that information at your own risk.
